These Terms & Conditions (“Terms”) govern your use of thebodycure.net, all related websites, digital products, memberships, programs, courses, materials, and services offered by The BODY Cure, Inc., including UNCONDITIONED (collectively, the “Services”).By accessing or using our Services, you agree to be bound by these Terms.If you do not agree to these Terms, please do not use our Services.

1.Educational Purposes Only

The BODY Cure and all related Services are intended for educational and informational purposes only.

Nothing contained within our Services is intended to constitute or substitute for medical, psychological, psychiatric, therapeutic, legal, or financial advice, diagnosis, or treatment.

The BODY Cure does not provide psychotherapy, psychiatric care, crisis intervention, or medical services.

Participation in our Services does not create a therapist-client, doctor-patient, fiduciary, or other licensed professional relationship between you and The BODY Cure, Inc. or Melanie Wilder.

2.Personal Responsibility

By participating in our Services, you acknowledge that you are voluntarily engaging with educational material involving topics such as emotional processing, conditioning, trauma, attachment, nervous system regulation, hypnosis, meditation, visualisation, self-development, and behavioural change.

You understand and agree that you are solely responsible for your physical, emotional, psychological, and mental wellbeing, decisions, actions, interpretations, and results.

You acknowledge that individual outcomes vary and that no guarantees are made regarding personal, relational, emotional, spiritual, financial, or professional results.

3.Mental Health Disclaimer

Our Services may not be appropriate for everyone.

If you are experiencing significant psychological distress, have been diagnosed with a serious mental health condition, are experiencing suicidal ideation, or are navigating unresolved trauma, we strongly encourage you to engage with this work only under the supervision and support of a licensed mental health professional.

4.Eligibility

You must be at least 18 years old to access or use our Services.

By using our Services, you represent and warrant that you are legally capable of entering into a binding agreement.

5.Memberships, Billing & Renewals

Certain Services are offered through recurring subscriptions, including monthly and annual memberships.

Both monthly and annual memberships may begin with a free 5-day trial period.

Unless cancelled before the trial period ends, your subscription will automatically convert into a paid membership using the payment method provided at checkout.

By enrolling in a subscription, you authorise The BODY Cure, Inc. to charge your selected payment method on a recurring basis unless and until you cancel.

Monthly memberships renew automatically each month.

Annual memberships renew automatically each year.

You may cancel your subscription at any time prior to your next billing date to prevent renewal.

Cancellation stops future renewals only and does not retroactively terminate or refund the current billing period.

We may offer promotional pricing or modify trial terms from time to time.

We reserve the right to change pricing at any time. Any pricing changes will apply prospectively and be communicated in advance where required by law.

6.Refund Policy

All purchases made through The BODY Cure, Inc. are final and non-refundable.

Due to the digital nature of our Services, we do not provide refunds for:

  • membership fees

  • subscription renewals

  • annual memberships

  • monthly memberships

  • digital products

  • downloadable materials

  • courses

  • programs

  • partial use or non-use of Services

Cancelling a subscription prevents future renewals only and does not entitle you to a refund for the current billing period.

We encourage all prospective members to make use of the free 5-day trial period before committing to a paid subscription.

By purchasing or continuing with a paid subscription after the trial period ends, you acknowledge and agree to this refund policy.

7.Intellectual Property

All content provided through our Services, including but not limited to videos, audio recordings, guided practices, written materials, graphics, branding, course structures, exercises, concepts, frameworks, downloads, and website content, is the intellectual property of The BODY Cure, Inc. and is protected by copyright, trademark, and other applicable intellectual property laws.

Your purchase grants you a limited, non-transferable, non-exclusive license for personal, individual use only.

You may not reproduce, share, distribute, republish, upload, sell, sublicense, modify, copy, teach from, commercially exploit, publicly display, or create derivative works from any portion of our Services without prior written permission.

Account sharing is strictly prohibited.

Unauthorised use of our intellectual property may result in immediate termination of access and legal action.

8.User Submissions & Testimonials

If you voluntarily submit comments, testimonials, emails, messages, reviews, feedback, survey responses, or other materials to The BODY Cure, Inc., you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, adapt, edit, and share those materials for marketing, promotional, educational, or business purposes.

We will never knowingly publish private or sensitive information beyond the scope reasonably implied by your submission.

You represent and warrant that:

  • you own or control the rights to the materials you submit

  • your submissions do not violate the rights of any third party

  • your submissions are truthful to the best of your knowledge

9.Acceptable Use

You agree not to use our Services:

  • to harass, abuse, threaten, or harm others

  • to interfere with the functionality or security of the Services

  • abusive conduct

While our Services are designed to support meaningful personal growth and transformation, we make no guarantees regarding specific outcomes or results.

Any examples, testimonials, or descriptions of potential outcomes are illustrative only and should not be interpreted as guarantees.

Your results depend on many factors beyond our control, including your participation, circumstances, decisions, and personal history.

11.Limitation of Liability

To the fullest extent permitted by law, The BODY Cure, Inc., Melanie Wilder, and all affiliated parties shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Services.

This includes, but is not limited to, emotional distress, psychological distress, business losses, loss of income, relationship outcomes, personal decisions, health-related consequences, interruption of service, and loss of data.

Your use of the Services is voluntary and at your own risk.

To the fullest extent permitted by law, the total liability of The BODY Cure, Inc. shall not exceed the amount you paid for the applicable Service within the twelve (12) months preceding the claim.

12.Indemnification

You agree to indemnify, defend, and hold harmless The BODY Cure, Inc., Melanie Wilder, and all affiliated parties from and against any claims, damages, liabilities, costs, or expenses arising out of:

  • your use of the Services

  • your violation of these Terms

  • your infringement of any rights of another party

  • your misuse of the content or materials provided

13.Arbitration & Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Services shall first be attempted to be resolved informally by contacting us at info@thebodycure.net.

If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in the State of New York, in accordance with the rules of the American Arbitration Association.

You agree that arbitration shall occur on an individual basis only.

You waive any right to participate in class actions, class arbitrations, or representative proceedings.

Each party shall bear its own legal fees and costs unless otherwise required by law.

14.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

15.Website Availability

We do not guarantee uninterrupted or error-free access to our Services.

We reserve the right to modify, suspend, discontinue, or remove any portion of the Services at any time without liability.

16.Privacy

Your use of our Services is also governed by our Privacy Policy.

17.Changes to These Terms

We reserve the right to update or modify these Terms at any time.

Changes will become effective immediately upon posting unless otherwise stated.

Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
